Terms of Service

    Welcome to Farba. Farba currently provides profile/portfolio pages for businesses and email collection from visitor contact forms. By accessing or using Farba, you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Service.

    1. Definitions

    - “Farba”, “we”, “our”, or “us” refers to the platform and its operator.
    - “Professionals” or “Businesses” are creative service providers using Farba to publish portfolio/profile pages and collect visitor emails.
    - “Visitors” are end users who view public pages and may submit their email through profile forms.
    - “Service” means the Farba website, apps, and related features.

    2. Platform Role

    Farba provides tools for presenting portfolios and collecting leads via email forms. Businesses are solely responsible for the legality, accuracy, and ownership of content they publish.

    3. Accounts & Eligibility

    You must be at least 18 years old and have the legal capacity to enter into these Terms. You agree to provide accurate and complete account information and to keep it up to date. You are responsible for all activity on your account and for maintaining the confidentiality of your login credentials.

    4. Paid Subscription Terms for Businesses

    Businesses may purchase a paid subscription to access enhanced features on the Farba platform. The following terms apply to paid subscriptions:

    • 14-Day Right of Withdrawal: As a Business, you have the right to withdraw from your paid subscription for a full refund within 14 days of your initial purchase. To exercise this right, you must inform us of your decision to cancel within the 14-day period.
    • Cancellation After 14 Days: After the initial 14-day period, you may cancel your paid subscription at any time. The cancellation will take effect at the end of your current billing period (monthly or annually), and your subscription will not be renewed.
    • No Refunds on Renewals: Payments for subscription renewals are non-refundable. Once a renewal payment has been processed, you will have access to paid features for the remainder of the new billing period.

    5. Current Service Scope

    Farba currently supports portfolio/profile publishing, contact email capture, and analytics/reporting. Booking and payment features may be introduced or changed in the future.

    6. Data & Analytics

    We use Google Analytics on non-public-profile Farba pages. Public profile pages use a server-side load counter that can log path, IP address, timestamp, and user-agent.

    7. User Content & IP

    Professionals may upload content (for example, portfolio images) to showcase their work. Professionals retain ownership of their content. By uploading content, you grant Farba a non-exclusive, worldwide, royalty-free license to host, display, and distribute the content in and through the Service solely for the purpose of operating and promoting your listings on Farba. We claim no ownership rights and will delete any business information and uploaded content upon request or account deletion, subject to any legal obligations to retain records.

    You represent and warrant that you have all rights necessary to upload and use the content and that your content does not infringe or violate any third-party rights or laws. We may remove content that violates these Terms or applicable law. If you believe content infringes your rights, contact us with details so we can review and, where appropriate, remove it.

    8. Acceptable Use

    You may not misuse the Service or help anyone else do so. Prohibited conduct includes: violating laws or regulations, posting illegal or harmful content, impersonating others, interfering with the security or operation of the Service, attempting to scrape or reverse engineer the Service, and infringing intellectual property rights.

    9. Visitor Submissions

    Visitors may submit emails via profile forms. Businesses are responsible for lawful use of collected contact data.

    10. Privacy

    Your use of the Service is subject to our Privacy Policy and Cookie Policy, which describe how we collect and use data, including the use of essential cookies for authentication and language preferences, plus the analytics practices described in our Cookie Policy.

    11. Service Changes & Availability

    We may modify, suspend, or discontinue any part of the Service at any time, including for maintenance or updates. We are not liable for any unavailability or loss resulting from such actions.

    12. Disclaimers

    THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FARBA DOES NOT CONTROL OR GUARANTEE ANY PROFESSIONAL’S SERVICES OR AVAILABILITY.

    13. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, FARBA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY BOOKINGS. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN FEES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.

    14. Indemnification

    You agree to defend, indemnify, and hold harmless Farba from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from or related to your use of the Service, your content, your interactions with other users, or your violation of these Terms or applicable law.

    15. Governing Law & Disputes

    These Terms are governed by the laws of Germany. The exclusive venue for any disputes arising out of or relating to these Terms or the Service will be the courts located in Berlin, Germany.

    16. Changes to These Terms

    We may update these Terms from time to time. If we make material changes, we will provide notice as appropriate (for example, by email or within the Service). Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
