Welcome to Farba. Farba is a booking platform for creative professionals (such as tattoo artists, nail artists, and hair stylists) that enables businesses to create booking pages, showcase portfolios, manage schedules, and accept upfront payments through Stripe’s marketplace functionality. By accessing or using Farba, you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Service.
- “Farba”, “we”, “our”, or “us” refers to the platform and its operator.
- “Professionals” or “Businesses” are creative service providers using Farba to list, promote, and sell their services.
- “Clients” or “Customers” are end users who discover Professionals, create bookings, and pay for services through Farba.
- “Service” means the Farba website, apps, and related features.
Farba provides a marketplace that connects Professionals and Clients. We are not a party to, and do not control, the agreements between Professionals and Clients. Professionals are solely responsible for the services they offer and provide, including quality, safety, legality, pricing, and fulfillment. Farba does not guarantee any outcomes, availability, or results and is not responsible for interactions between users.
You must be at least 18 years old and have the legal capacity to enter into these Terms. You agree to provide accurate and complete account information and to keep it up to date. You are responsible for all activity on your account and for maintaining the confidentiality of your login credentials.
Businesses may purchase a PRO subscription to access enhanced features on the Farba platform. The following terms apply to PRO subscriptions:
Professionals are responsible for their service listings, including pricing, availability, and their own cancellation policies, which must be clearly stated on their booking page.
When a booking is made through the Farba marketplace, the following terms apply:
Farba acts as a platform to facilitate these transactions and is not a party to the booking agreement between the Client and the Professional. We enforce the policies stated in these terms but do not control any additional policies set by the Professional.
Payments are processed via Stripe’s marketplace (e.g., Stripe Connect). Farba may charge platform or transaction fees disclosed at checkout or in your account. Payouts to Professionals are handled by Stripe subject to their onboarding, verification, and compliance requirements. Farba does not store full card details. Chargebacks, reversals, and payment disputes are the responsibility of the Professional. Professionals are solely responsible for determining and remitting applicable taxes. Farba may offset or withhold amounts to address fraud, abuse, chargebacks, or legal obligations.
Professionals may upload content (for example, portfolio images) to showcase their work. Professionals retain ownership of their content. By uploading content, you grant Farba a non-exclusive, worldwide, royalty-free license to host, display, and distribute the content in and through the Service solely for the purpose of operating and promoting your listings on Farba. We claim no ownership rights and will delete any business information and uploaded content upon request or account deletion, subject to any legal obligations to retain records.
You represent and warrant that you have all rights necessary to upload and use the content and that your content does not infringe or violate any third-party rights or laws. We may remove content that violates these Terms or applicable law. If you believe content infringes your rights, contact us with details so we can review and, where appropriate, remove it.
You may not misuse the Service or help anyone else do so. Prohibited conduct includes: violating laws or regulations, posting illegal or harmful content, impersonating others, interfering with the security or operation of the Service, attempting to scrape or reverse engineer the Service, and infringing intellectual property rights.
Clients may leave reviews or ratings. Farba may moderate or remove reviews that are abusive, irrelevant, or violate these Terms or law, but we do not endorse user reviews and are not responsible for their accuracy.
Your use of the Service is subject to our Privacy Policy and Cookie Policy, which describe how we collect and use data, including the use of Google Analytics for aggregated, anonymous usage metrics and essential cookies for authentication and language preferences.
We may modify, suspend, or discontinue any part of the Service at any time, including for maintenance or updates. We are not liable for any unavailability or loss resulting from such actions.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FARBA DOES NOT CONTROL OR GUARANTEE ANY PROFESSIONAL’S SERVICES OR AVAILABILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FARBA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY BOOKINGS. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN FEES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.
You agree to defend, indemnify, and hold harmless Farba from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from or related to your use of the Service, your content, your interactions with other users, or your violation of these Terms or applicable law.
These Terms are governed by the laws of Germany. The exclusive venue for any disputes arising out of or relating to these Terms or the Service will be the courts located in Berlin, Germany.
We may update these Terms from time to time. If we make material changes, we will provide notice as appropriate (for example, by email or within the Service). Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
